Terms of Service
By using our services, you agree to these Terms. Violations may result in account termination. Please read carefully — if anything is unclear, email support@cushell.com.
Introduction
- The Terms of Service is a document which states the rules governing the use and operation of CUSHELL and its products and/or services, and automatically applies to any CUSHELL infrastructure user and/or customer.
- The Terms of Service are subject to amendment at any time without prior or subsequent notice.
Liabilities
- CUSHELL cannot be held liable for any misuse of or damage caused by content taken from its servers — once downloaded, submitted content becomes the responsibility of the third party.
- CUSHELL is not liable for anything transmitted or received on its servers, but will assist law enforcement agencies should the need arise with any relevant information it may have available.
Laws
- CUSHELL will punish very severely if a case of juvenile pornography arises on one of our servers. Any model that acts in pornographic content must be over 18 years old, as per the law.
- CUSHELL will punish severely any piracy of a network, domain, server or other equipment — owned by CUSHELL or not. This includes Internet-wide attacks such as DoS attacks or botnets.
- Any users hosted by CUSHELL must not post illegal material, must respect copyright laws and virtual property rights, and give proper credits if asked. Accounts of users found in violation will be terminated.
- Media and written content on this website, wiki, web panels or other end-user interfaces is the property of CUSHELL and copyrighted jointly by the creator and CUSHELL. Copying content verbatim may be subject to legal action.
Bouncer Requests
- You must not request more than one user account. You may add up to 2 networks to your account once accepted.
- You must not use false, invalid, or inaccurate details when requesting a bouncer.
- You must not request from Tor exit nodes, tunnels, Open VPN (including those requiring registration), free shells, other bouncer providers, proxies, IRCCloud, KiwiIRC, WSIRC or Mibbit.
- You must use a valid email. Disposable emails are not permitted.
- The IRC network you request must not be in the prohibited network list. Check spelling and port carefully.
- CUSHELL reserves the right to refuse service to anyone not in compliance with these Terms, for any justifiable reason.
- Flooding the support channels, disrupting conversations, or otherwise violating our channel rules is not permitted.
IRC Bouncers
- Clients cannot change their BindHost / vHost at any time.
- Clients cannot change IRC servers directly. Join one of our official networks or email support to request a change.
- Clients cannot add, remove, or change IRC networks themselves. Use the request form or email support.
- Bouncers must not be used for XDCC / DCC.
- Account sharing is not permitted under any circumstances.
- Only ONE free account per user, connecting to up to TWO IRC networks.
- Use of Tor exit nodes, tunnels, Open VPN, other bouncer providers, banned IPs, free shells, or proxies to connect is forbidden.
- Using our service alongside other bouncer providers to inflate channel counts, spam, or evade bans is forbidden.
- Bouncers must not be used to evade any kind of ban (server ban, channel ban, etc.).
- CUSHELL reserves the right to delete any account not in compliance with these Terms.
Account lifecycle
- 7 days — unused accounts (never logged into IRC) are removed.
- 30 days — disabled accounts with no appeal are removed.
- 60 days — inactive accounts (no access) are removed.
- Accounts breaking network-specific rules deemed inappropriate by that network's staff will be disabled or removed.
- Accounts confirmed compromised (social engineering, leaked password, publicly posted credentials) will be disabled.
- CUSHELL will remove networks from accounts upon request of the IRC network's operators or administrators.
Privacy Policy
- CUSHELL may store IP addresses and hostnames you have used, until your account is deemed inactive or closed.
- Details provided during requests may be stored for up to one year after account removal.
- CUSHELL does not retain IRC logs or data sent through the bouncer by default. If the log module is enabled, logs are viewable in the web panel. To have them deleted with your account, email support — we can also email your logs before deletion on request.
- Information may be passed to ISPs or law enforcement upon request or in cases of serious abuse.
- Information may be passed to IRC network staff when account abuse extends beyond our service.

Donations
- Donations are accepted in any currency.
- Only via PayPal.
- All donations are checked against a fraud system.
- Donations are non-refundable under any circumstances.
- Donating does not grant additional features or account privileges.

- CUSHELL reserves the right to change the Terms at any time and will notify users by email or announcement when necessary.
